Terms of Service

Please read these Terms of Service carefully before using ManageMyStable. By creating an account or using the Service you agree to be bound by these Terms.

1. Definitions

In these Terms the following words have the following meanings:

  • "Service" means the ManageMyStable web and mobile application and all associated features, APIs, and content.
  • "we", "us", "our" means ManageMyStable Limited, a company registered in England & Wales under company number 17375835, whose registered office is at 128 City Road, London, EC1V 2NX, United Kingdom, being the operator of ManageMyStable.
  • "you", "your" means the individual or organisation that has agreed to these Terms and holds the account.
  • "Content" means any data, text, files, photographs, records, or other material you upload to or create within the Service.
  • "Subscription" means a paid or free-tier plan that grants access to the Service.

2. Agreement to terms

By registering for an account, accessing, or using the Service you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Notice. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

If you do not agree to these Terms, you must not use the Service.

3. Description of service

ManageMyStable is a cloud-based equine stable-management platform available via web browser and mobile application. The Service provides tools for managing horse profiles, passports, health records, calendars, feed plans, contacts, checklists, activity logs, competition results, and related equine management tasks.

Features available to you depend on your Subscription plan. We reserve the right to add, modify, or discontinue features at any time, provided we give you reasonable notice of any material changes.

4. Accounts

Eligibility

You must be at least 18 years of age to create an account and use the Service. By registering you confirm that you meet this requirement.

Registration

You agree to provide accurate, current, and complete information when creating your account and to keep that information up to date. Accounts registered with false or misleading information may be suspended or terminated.

Account security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at hello@managemystable.com if you suspect any unauthorised use of your account. We are not liable for any loss resulting from unauthorised use of your account where you have failed to keep your credentials secure.

One account per person

Each account is for use by a single individual. You may not share your account credentials with others or allow third parties to access the Service through your account, except where we have expressly provided multi-user or team functionality within your Subscription plan.

5. Subscription plans and payment

Plans

The Service is offered on a subscription basis. Details of available plans and their features are set out on our Pricing page. A free tier may be available with limited functionality.

Billing

Paid Subscriptions are billed in advance on a monthly or annual basis depending on the plan you select. All prices are in GBP and inclusive of VAT where applicable. Payment is processed by our third-party payment provider. By providing payment details you authorise us to charge you on a recurring basis until you cancel.

Price changes

We may change Subscription prices from time to time. We will give you at least 30 days' notice of any price increase by email to the address registered on your account. Your continued use of the Service after the new price takes effect constitutes acceptance of the new price. If you do not accept a price increase you may cancel your Subscription before the new price applies.

Failed payments

If a payment fails we will attempt to notify you and retry. If payment remains outstanding after a reasonable period we reserve the right to suspend or downgrade your account to the free tier until payment is resolved.

6. Free trial

We may offer a free trial period for paid Subscription plans. Where a free trial is offered:

  • The trial period and applicable plan will be stated at sign-up.
  • You may be required to provide payment details to start a trial. If so, you will not be charged until the trial ends.
  • If you do not cancel before the trial period ends, your Subscription will automatically convert to the paid plan and you will be charged at the applicable rate.
  • You may cancel at any time during the trial period without charge.
  • We reserve the right to limit free trials to one per person or organisation.

7. Cancellation and refunds

Cancellation

You may cancel your Subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until that date.

Refunds

We do not offer refunds for any portion of a billing period that has already commenced, except where required by applicable law. If you cancel an annual Subscription within 14 days of initial purchase and have not made substantial use of the Service, you may request a refund by contacting us at hello@managemystable.com. We will consider such requests at our discretion.

Effect of cancellation

On cancellation your account will revert to the free tier (if available) or be closed. Your Content will be retained for 30 days following the end of your paid period, during which time you may export it. After that period we may delete your Content in accordance with our data retention practices.

8. Acceptable use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

  • Use the Service in any way that violates applicable local, national, or international law or regulation.
  • Upload, transmit, or store any Content that is unlawful, defamatory, harassing, fraudulent, or infringes any third party's intellectual property or other rights.
  • Attempt to gain unauthorised access to any part of the Service, our systems, or the accounts of other users.
  • Introduce viruses, trojans, worms, or other malicious or technologically harmful material.
  • Use automated means (bots, scrapers, crawlers) to access or collect data from the Service without our prior written consent.
  • Resell, sublicence, or make the Service available to third parties other than as expressly permitted by your Subscription plan.
  • Use the Service to send unsolicited communications or spam.
  • Attempt to reverse engineer, decompile, or disassemble any part of the Service.
  • Take any action that imposes an unreasonable or disproportionately large load on our infrastructure.

We reserve the right to investigate any suspected breach of this section and to take appropriate action, including suspension or termination of your account.

9. Your content and data

Ownership

You retain full ownership of all Content you upload to or create within the Service. We do not claim any ownership rights over your Content.

Licence to us

By uploading Content you grant us a limited, non-exclusive, royalty-free licence to store, copy, process, and display your Content solely as necessary to provide and maintain the Service for you. This licence terminates when you delete the Content or close your account, subject to our data retention obligations.

Your responsibility for Content

You are solely responsible for your Content and for ensuring that it does not violate any applicable law or third-party rights. You must not upload Content relating to other individuals without their knowledge and consent where required by law.

Backups and export

We take reasonable measures to back up your data as part of our infrastructure operations. However, you are responsible for maintaining your own copies of important data. We provide data export functionality within the Service to assist you in doing so. We do not guarantee that any specific version of your data will be recoverable following an error or data loss event.

Deletion

You may delete individual records or your entire account at any time. Deletion of your account will result in the permanent deletion of your Content, subject to any applicable legal retention obligations and the 30-day post-cancellation retention period described in section 7.

10. Data protection and processing

We process personal data in connection with the Service in accordance with our Privacy Notice, which forms part of these Terms. Our Privacy Notice sets out what data we collect, how we use it, and your rights under UK data protection law.

Where you store personal data about third parties (such as professional contacts or other individuals) within the Service, you do so as a data controller and are responsible for ensuring that you have a lawful basis for that processing and that you comply with applicable data protection law. We act as a data processor in respect of such data. Our Data Processing Agreement is available online and governs such processing. A countersigned copy is available on request by contacting hello@managemystable.com.

11. Intellectual property

The ManageMyStable platform, including its software, design, branding, logos, and all content produced by us, is owned by us or our licensors and is protected by copyright, trade mark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your own internal purposes in accordance with these Terms. You may not copy, modify, distribute, sell, sublicence, or create derivative works of any part of the Service without our prior written consent.

Any feedback, suggestions, or ideas you provide to us regarding the Service may be used by us without restriction or compensation to you.

12. Third-party services

The Service relies on third-party providers, including Amazon Web Services for infrastructure and hosting, and a payment processor for billing. These providers operate under their own terms and privacy policies. We are not responsible for the acts or omissions of third-party service providers, provided we have taken reasonable care in selecting them.

The Service may contain links to third-party websites or resources. Such links are provided for convenience only. We do not endorse and are not responsible for the content, products, or services offered by third-party websites.

13. Service availability

We aim to provide a reliable and available Service, but we do not guarantee uninterrupted, error-free, or secure access. The Service is provided over the internet and its availability may be affected by factors outside our control, including network conditions, third-party infrastructure, and maintenance.

We will endeavour to give advance notice of planned maintenance where possible. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, and will give reasonable notice where we intend to do so in a way that materially affects your use.

14. Suspension and termination

Termination by you

You may close your account at any time by following the account deletion process within the Service or by contacting us. Closure takes effect immediately for free accounts and at the end of the current billing period for paid Subscriptions.

Termination or suspension by us

We may suspend or terminate your account with immediate effect if:

  • You materially breach these Terms and fail to remedy the breach within 7 days of written notice from us (where the breach is capable of remedy).
  • You breach these Terms in a way that cannot be remedied.
  • You fail to pay any amount due and fail to remedy this within 14 days of notice.
  • We are required to do so by law or a regulatory authority.

We may also suspend the Service to all users temporarily for maintenance, security, or operational reasons, and will endeavour to give advance notice where practicable.

Effect of termination

On termination of your account for any reason, your right to access the Service ceases immediately (subject to any paid period that has already been paid for). Sections of these Terms that by their nature should survive termination will do so, including sections 9, 10, 11, 15, 16, 17, 19, and 20.

15. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

ManageMyStable is a stable management tool. It is not a veterinary, medical, legal, or financial advisory service. Any information or records stored within the Service are for your own management purposes only and do not constitute professional advice. You should always consult a qualified professional for veterinary, legal, or financial matters.

We do not warrant that the Service will meet your specific requirements, that it will be uninterrupted or error-free, or that defects will be corrected.

16. Limitation of liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, or business interruption, arising out of or in connection with your use of the Service.

Our total aggregate liability to you in respect of all claims arising out of or in connection with these Terms or the Service shall not exceed the greater of (a) the total Subscription fees paid by you in the 12 months immediately preceding the event giving rise to the claim, or (b) £100.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

17. Indemnification

You agree to indemnify, defend, and hold harmless ManageMyStable Limited and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use of the Service in breach of these Terms; (b) your Content; or (c) your violation of any applicable law or third-party rights.

18. Force majeure

We will not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, civil unrest, governmental action, failure of internet infrastructure, or failure of third-party service providers. We will notify you as soon as practicable of any such event and will use reasonable endeavours to resume normal service as soon as possible.

19. Dispute resolution

If you have a dispute with us arising out of or relating to these Terms or the Service, we encourage you to contact us first at hello@managemystable.com so that we can try to resolve the matter informally. We will endeavour to respond within 10 working days.

If we are unable to resolve the dispute informally within 30 days of your initial contact, either party may pursue resolution through the courts in accordance with section 20 below.

20. Governing law

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.

Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms.

21. Changes to these terms

We may update these Terms from time to time. Where we make material changes we will notify you by email to the address registered on your account at least 14 days before the changes take effect. The updated Terms will be posted on this page with a revised "last updated" date.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the new Terms. If you do not agree to the revised Terms, you must stop using the Service and may cancel your Subscription in accordance with section 7.

22. General

  • Entire agreement. These Terms, together with our Privacy Notice and any other policies referenced herein, constitute the entire agreement between you and us in relation to the Service and supersede all prior agreements and understandings.
  • Severability. If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
  • Waiver. A failure or delay by us in exercising any right or remedy under these Terms does not constitute a waiver of that or any other right or remedy.
  • Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations to a successor in connection with a merger, acquisition, or sale of assets, and will notify you if we do so.
  • Notices. Any notices from you to us should be sent to hello@managemystable.com. We will send notices to you at the email address registered on your account.
  • Third-party rights. These Terms do not confer any rights on third parties under the Contracts (Rights of Third Parties) Act 1999.
